Terms of Service

These Terms of Service ("Terms") govern your use of the ProxyKite website, panel, API, agent software and cloud routing service (together, the "Service"), provided by ProxyKite, Hedayet Nagar, Jateswar, Alipurduar, West Bengal 735216, India ("ProxyKite", "we", "us"). By creating an account or using the Service you agree to these Terms. If you use the Service for a company, you confirm you can bind that company to them.

1. The Service

ProxyKite is software that turns 4G/LTE modems ("dongles") that you own and operate into HTTP and SOCKS5 proxies, and routes them to a public port on our cloud router. You supply the hardware, SIM cards and mobile data plans; we do not sell IP addresses, SIM cards, data plans or third-party traffic. Features are described on our website and in our documentation and may change over time.

2. Accounts

• You must be at least 18 years old and give accurate account information.
• You are responsible for keeping your password, API tokens and proxy credentials secret, and for everything done with your account, including by team members you invite.
• Tell us promptly at support@proxykite.com if you suspect unauthorised use.

3. Pricing, billing and payment

The Service is billed per active dongle per month at the price shown on our website at the time of purchase (currently US$9 per dongle per month, plus any applicable taxes). Subscriptions renew automatically each billing period until cancelled, and the quantity follows the number of active dongles on your account.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment terms, taxes and invoices are handled by Paddle under the Paddle Buyer Terms.

If a payment fails, we may pause your proxies until the balance is paid. We may change prices with at least 30 days' notice by email; the new price applies from your next billing period after the notice.

4. Cancellation and refunds

You can cancel at any time; the Service continues until the end of the paid period. Refunds are covered by our Refund Policy, which includes a 14-day money-back guarantee.

5. Acceptable use

You are solely responsible for the traffic sent through your proxies and must comply with all applicable laws and your mobile carrier's terms. You must not use the Service, or let others use your proxies, to:

• commit or facilitate fraud, identity theft, phishing, carding, or account takeover;
• send spam or unsolicited bulk messages, including SMS;
• attack, scan or disrupt any network or system (including denial-of-service attacks or brute-forcing logins), or spread malware;
• access content or systems without authorisation, or infringe intellectual property or privacy rights;
• distribute child sexual abuse material or any other illegal content;
• resell or share access in a way that hides the identity of the people using it from us when we are lawfully required to know it;
• interfere with the Service, our cloud router or other customers, or try to bypass limits or security controls.

We may suspend or terminate accounts that break this section, with or without notice, and cooperate with lawful requests from authorities.

6. Your data and content

You keep all rights to your data. You give us permission to process it only to provide and support the Service, as described in our Privacy Policy.

7. Agent software

We grant you a non-exclusive, non-transferable licence to install and run the ProxyKite agent on machines you control, only to use the Service while your account is active. You may not copy, modify, reverse engineer or redistribute it, except as allowed by law. The agent connects out to our servers and accepts configuration and commands from your panel account.

8. Availability and support

We aim to keep the Service available at all times but do not guarantee uninterrupted operation. Mobile networks, your hardware, your internet connection and your carrier are outside our control. Support is provided by email and WhatsApp.

9. Disclaimer

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose, to the extent permitted by law.

10. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for loss of profits, data or business. Our total liability for any claim relating to the Service is limited to the amount you paid us in the three months before the claim arose.

11. Indemnity

You agree to indemnify us against claims, losses and costs arising from traffic sent through your proxies or from your breach of these Terms.

12. Termination

You may close your account at any time. We may suspend or end your access for breach of these Terms or non-payment. After termination your proxies stop working and we delete your account data as described in our Privacy Policy.

13. Changes

We may update these Terms. Material changes will be notified by email or in the panel at least 14 days before they take effect. Continuing to use the Service after that means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of India. Courts in Alipurduar, West Bengal have exclusive jurisdiction, without affecting any mandatory consumer rights you have where you live.
